Health Premium Tax Credit Relief for Spousal Abuse Victims

Any taxpayer with low-income can generally qualify for a refundable tax credit if health insurance is purchased through the government exchange. However, the Affordable Care Act requires married couples to file jointly for a married person to take advantage of the health premium tax credit. This can be a problem for spousal abuse victims who are married at the time of filing and not living together. The government will allow victims of spousal abuse victims to still take the health premium tax credit if the victim is living apart from his/her spouse at the time of filing.
